论刑事附带民事诉讼中精神损害赔偿制度的确立

The Establishment of the System Mental Damage Compensation in Civil Suit Collateral to Criminal Proceedings

摘要: 我国现行的刑事法律规范中明确否认了刑事被害人的精神损害赔偿请求权，这既造成了法律之间的相互矛盾，也不利于保障被害人的合法权益，在法律实践中产生了很多亟待解决的问题，将精神损害赔偿制度确立于刑事附带民事诉讼中迫在眉睫。并且，精神损害赔偿制度在我国有着坚实的理论基础以及良好的实践基础，采取在法律规范中确立、赋予被害人程序选择权等措施可以使这一制度更好的发挥作用，达到国家设立刑事附带民事诉讼的目的。

Abstract: The current criminal law in our country expressly denies criminal victims’ claim for spiritual damage compensation claims. It causes the contradiction in the law, and it is unfavorable to the protection of the legitimate rights of the victim. There are a lot of problems to be solved in the legal practice, and the system of mental damage compensation (SMDC) established in the looming in the civil suit collateral to criminal proceedings. SMDC has a solid theoretical foundation and good basis in practice in our country. We can take measures to establish SMDC in the criminal law, giving victims the options to mention the procedure, forming a complete set of national SMDC and so on to improve the system and achieve the goal of setting up the civil suit collateral to criminal proceedings.
