滥用标准必要专利权产生垄断的原因与反垄断规制的必要性分析

摘要: 权利滥用是任何一个时期都会出现的问题，技术标准化下的技术锁定容易进一步加剧了知识产权的滥用。普通技术专利在经过多种博弈后进入标准并成为标准必要专利，专利技术的垄断性与标准的普适性相结合，在激烈的市场竞争下经济人会自觉或不自觉地排除或限制竞争以实现自身利益的最大化，垄断行为因此产生。在现有民法、知识产权法以及标准化组织对该类垄断行为规制存在明显缺陷时，反垄断以其自身优势具有介入的合理性与必要性。

Abstract: Power Abuse occurs in any historical period and technology standardization would aggravate the abuse of intellect property right for the reason of technical locking. General patents jump into standard-essential patens (SEPs) after a variety of rules. The combination of monopoly and univer-sality of general patent and standard could easily put the market competitor into a monopoly posi-tion because the economic subjects would consciously or unconsciously exclude and restrict market competition to maximize their interest. The current civil law, contract law, intellectual property law and standardization organization cannot perfectly contract such kind of monopoly behaviors, so at this point, anti-monopoly law is a better choice with its advantages in solving the mentioned prob-lems.
