我国医疗损害鉴定处于一个“二元化”的鉴定模式之下，即医疗事故技术鉴定和医疗损害司法鉴定并存的“双轨制”鉴定模式。这种“二元化”的鉴定模式不利于有效公正的解决医疗纠纷案件，给司法诉讼程序带来诸多不便。为了有效解决医患纠纷，提高司法诉讼效率，化“二元化”的鉴定模式为“一元化”鉴定模式是十分必要的。构建“一元化”鉴定模式就是保留和完善医疗损害司法鉴定模式，并在法庭审理阶段完善专家辅助人制度。
Our country’s identification of
medical malpractice is in a “dual” of the identification mode, namely, coexistence of “dual track” identification mode of the technology identification of medical accident and medical damage of the judicial identification. This “duality” identification mode is not conducive to the effective fair solution to medical disputes, and brings a lot of inconvenience to judicial proceedings. In order to solve medical disputes, and improve judicial efficiency, translating “duality” identification mode into the “unified” identification mode is very necessary. Construction of the “unified” identification mode is to retain and improve medical damage identification of judicial mode, and in the court to perfect the expert auxiliary system.
