我国前科消灭制度建立必要性研究

Research on the Necessity of Establishing a Criminal Record Elimination System in China

摘要: 前科消灭制度的价值在于，既要发挥其对犯罪前科的预防作用，又要重视对其人权的保护，从而为犯罪人确立一种回归社会的途径。在我国，前科是最具代表性的犯罪附随后果。目前，我国在构建前科消灭机制时，仍面临着与传统价值冲突、与现有法律体系冲突、配套制度不完善等问题，但又具有适用于建设多元前科消灭制度的可行性，我国刑法宽严相济的政策取向也是前科消灭制度建立的有力支撑。

Abstract: The value of the criminal record elimination system lies in preventing recidivism while safeguarding human rights, paving the way for offenders’ social reintegration. In China, a criminal record exemplifies lasting post-conviction consequences. Presently, establishing such a system encounters challenges like conflicting with traditional values, inconsistencies within the legal framework, and inadequate supporting mechanisms. Nonetheless, there’s feasibility for a multifaceted rehabilitation approach, and the policy of combining severity with leniency in Chinese criminal law provides a strong foundation for its implementation.
