跨境电商物流发展的法律风险与对策研究

Research on Legal Risks and Countermeasures of Cross-Border E-Commerce Logistics Development

摘要: 自数字经济蓬勃发展以来，跨境电商作为数字经济的一个重要组成部分，其高效、便捷的特点为国际贸易带来了巨大便利。然而，随着跨境电商对全球贸易的驱动，也带来了诸多潜在的法律问题，影响着行业的健康发展。据此，本文将分析当前跨境电商物流领域的发展现状和趋势，明晰跨境电商在数字时代的角色定位，进而厘清跨境电商物流已有的以及将有的法律风险，民事上包括知识产权侵权、数据信息安全、刑事上主要表现为走私犯罪。最终探讨出可行的包括完善相关法律法规、加强跨境电商物流行业间的监管以及物流企业内部间的监管、促进国际合作三点法律风险防控措施，以期为跨境电商物流领域的法律规范的制订提出参考性建议。

Abstract: Since the vigorous development of the digital economy, cross-border e-commerce as an important part of the digital economy, its efficient and convenient characteristics for international trade has brought great convenience. However, as cross-border e-commerce drives global trade, it also brings many potential legal problems, affecting the healthy development of the industry. Based on this, this paper will analyze the current development status and trend of cross-border e-commerce logistics, clarify the role positioning of cross-border e-commerce in the digital era, and then clarify the existing and future legal risks of cross-border e-commerce logistics, including intellectual property infringement, data information security, and smuggling crimes in criminal aspects. Finally, feasible legal risk prevention and control measures including improving relevant laws and regulations, strengthening the supervision between cross-border e-commerce logistics industries and logistics enterprises, and promoting international cooperation are discussed, in order to put forward reference suggestions for the formulation of legal norms in the field of cross-border e-commerce logistics.
