自动化行政中相对人的权利保障——以正当程序规制为切入点

Guarantee of the Rights of the Counterparty in Automated Administration—Due Process Regulation as an Entry Point

摘要: 随着信息技术的快速发展，自动化行政在行政治理中发挥着重要的作用。然而，在“效率优先”的导向下，自动化行政也对传统行政法中的正当程序带来了挑战，不利于保护行政相对人的合法权利。本文以正当程序规制为切入点，基于正当程序的核心要素，揭示自动化行政对程序正义原则的结构性挑战，分析自动化行政可能对行政相对人的程序性权利造成的冲击，探索符合技术特征的程序权利保障范式，切实保障行政相对人的合法权利，推动自动化行政健康有序的发展。

Abstract: With the rapid development of information technology, automated administration plays an important role in administrative governance. However, under the orientation of “efficiency first”, automated administration also brings challenges to the due process in traditional administrative law, which is not conducive to the protection of the legitimate rights of the administrative relative. This paper takes the regulation of due process as an entry point, reveals the structural challenge of automated administration to the principle of procedural justice based on the core elements of due process, analyzes the impact of automated administration on the procedural rights of the administrative relative, and explores the paradigm of safeguarding procedural rights in conformity with the technological characteristics, to effectively safeguard the legitimate rights of the administrative relative and promote the healthy and orderly development of automated administration.
