网络虚拟财产继承法律问题研究

Research on Legal Issues of Inheritance of Virtual Property on the Internet

摘要: 随着信息技术的快速发展，我国已全面进入互联网数字时代。在此背景下，虚拟财产的权属争议及相关法律纠纷呈现出逐年递增的趋势。尽管《中华人民共和国民法典》第一百二十七条明确规定了对数据及网络虚拟财产的保护，但该条款在虚拟财产继承问题的具体适用上仍存在明显局限性。该条款仅作为原则性规定，指出“法律对数据、网络虚拟财产的保护有规定的，依照其规定”，而未能提供具体的操作规范，导致我国在虚拟财产继承领域的法律规制仍存在较大空白。基于此，本研究旨在系统分析我国虚拟财产继承面临的主要问题，并据此提出具有针对性的完善建议。

Abstract: With the rapid development of information technology, China has entered the digital era of the Internet. In this context, ownership disputes and related legal disputes regarding virtual property have shown an increasing trend year by year. Although Article 127 of the “Civil Code of the People’s Republic of China” clearly stipulates the protection of data and virtual property on the internet, there are still significant limitations in its specific application to the issue of virtual property inheritance. This clause only serves as a principle provision, stating that “if the law has provisions for the protection of data and virtual property on the internet, they shall be followed”, without providing specific operational norms, resulting in a significant gap in the legal regulation of virtual property inheritance in China. Based on this, this study aims to systematically analyze the main problems faced by virtual property inheritance in China and propose targeted improvement suggestions accordingly.
