跨境电子商务中消费者权益保护问题研究
Research on the Protection of Consumer Rights and Interests in Cross-Border E-Commerce
摘要: 跨境电子商务契合数字经济时代要求高速发展,在带来消费便利和强经济效益的同时也导致消费者权益受到侵害,在跨境交易中消费者隐私权、知情权和公平交易权等多方权益阙位,还暴露出跨境电子商务监管不力,纠纷解决机制单一,法律适用时地域法律差异过大导致消费者维权难度高的问题。针对相关不足,应当及时加以完善,通过完善相关法律细则、加强国际间信息共享和技术保护协同来多举措加强对消费者权益的保护力度;以行业自治和政府部门的外力监管来对提升跨境电子商务平台和商家的监管强度以促进其规范交易行为;在传统纠纷解决机制之外考量在线纠纷解决机制,建立多元纠纷解决机制;面对法律适用难题,应积极推动国内法律框架与国际法律接轨,以减少消费者维权时的适用阻力,促进跨境电子商务中消费者权益保护。
Abstract: Cross-border e-commerce meets the requirements of the digital economy era and requires rapid development, which not only brings consumption convenience and strong economic benefits, but also leads to the infringement of consumer rights and interests, and the lack of consumer rights and interests such as privacy, right to know and right to fair trade in cross-border transactions also exposes the problems of weak supervision of cross-border e-commerce, single dispute resolution mechanism, and excessive differences in regional laws when applying laws, resulting in high difficulty in protecting consumer rights. In response to relevant deficiencies, they should be improved in a timely manner, and multiple measures should be taken to strengthen the protection of consumer rights and interests by improving relevant laws and regulations, strengthening international information sharing and coordination of technological protection; enhance the supervision intensity of cross-border e-commerce platforms and merchants through industry autonomy and external supervision by government departments to promote their standardized transaction behavior; consider online dispute resolution mechanisms in addition to traditional dispute resolution mechanisms, and establish multiple dispute resolution mechanisms. In the face of difficulties in the application of law, it is necessary to actively promote the integration of the domestic legal framework with international law, so as to reduce the resistance to the application of consumer rights protection and promote the protection of consumer rights and interests in cross-border e-commerce.
