盲盒经济中的消费者权益保护研究
Research on the Protection of Consumers’ Rights and Interests in the Blind Box Economy
摘要: 在数字经济与电子商务深度融合的背景下,以不确定性体验为特征的盲盒消费模式近年来呈现爆发式增长。然而该领域暴露出售后保障机制失灵、隐藏款概率参数监管缺位、二级市场投机炒作乱象蔓延等突出问题,致使消费者知情权与公平交易权遭受系统性侵害。本文基于射幸合同理论框架,解构盲盒交易法律关系特征,针对产品信息披露失真、概率算法失范、市场风险传导等关键症结,提出涵盖运营规范、概率公示、反投机机制等维度的立法优化路径,着力构建兼具创新包容性与风险防控性的制度屏障,引导新型消费业态实现可持续发展。
Abstract: Under the backdrop of the deep integration of the digital economy and e-commerce, the blind box consumption model characterized by uncertainty experiences has witnessed explosive growth in recent years. However, this field has exposed prominent problems such as the failure of after-sales guarantee mechanisms, the lack of regulation on the probability parameters of hidden items, and the spread of speculative and manipulative practices in the secondary market, which have systematically infringed upon consumers’ rights to information and fair transactions. Based on the theoretical framework of chance contracts, this article deconstructs the legal relationship characteristics of blind box transactions and, in response to key issues such as distorted product information disclosure, unregulated probability algorithms, and the transmission of market risks, proposes legislative optimization paths covering operational norms, probability disclosure, and anti-speculation mechanisms. It aims to build a system barrier that is both innovative and inclusive and capable of risk prevention and control, guiding the sustainable development of new consumption formats.
