论网络虚拟财产的刑法保护

On the Criminal Law Protection of Network Virtual Property

摘要: 网络虚拟财产具有虚拟性、转移性、价值性的特征，分为货币类虚拟财产、物品类虚拟财产等表现形式。基于网络虚拟财产的财产性以及刑事可罚性等因素，对虚拟财产进行规制具有必要性以及可行性。我国对网络虚拟财产的刑法保护并不健全，实践中侵犯虚拟财产的行为多按照计算机信息系统罪、盗窃罪、侵犯通讯自由罪等罪名处理。对此，应当根据虚拟财产的类型差异采取分层处理思路，通过司法解释明确规则、限定保护范围、完善价值认定和取证机制，构建数据犯罪与财产犯罪相互衔接的刑法保护体系。

Abstract: Network virtual property is characterized by virtuality, transferability, and value, and manifests in forms such as currency-type virtual property and item-type virtual property. Given its proprietary nature and the attendant criminal culpability, the regulation of virtual property is both necessary and feasible. The current criminal law protection of network virtual property in China remains inadequate; in practice, infringements upon virtual property are often prosecuted under offenses such as crimes against computer information systems, theft, or crimes against freedom of communication. In response, a tiered approach should be adopted based on the typological differences of virtual property, with clear rules established through judicial interpretations, defined scope of protection, improved mechanisms for value assessment and evidence collection, and the construction of a cohesive criminal law protection system that bridges data-related crimes and property crimes.
