国际贸易中货物的标准问题讨论——以CISG为视角

A Discussion about the Standard of Goods in International Trade—From the Perspective of CISG

摘要: CISG第35条规定了货物相符的要求。除了货物的数量，质量，包装等传统上的物理特性所要求的标准，物理特性的延伸与非物理特性所要求的标准也越来越得到世界贸易领域的关注。与传统的将标准划分为公有标准与私有标准、自愿性标准与强制性标准的划分方法不同，本文提出从货物的特性区分货物的生产过程标准与产品标准，并且涉及到准强制性标准即事实上的强制标准。此外，本文还讨论了标准的利弊，对公法标准的判断以及公约管辖标准的必要性。

Abstract: The requirement of the conformity of goods is vested in the Article 35 of CISG. The conformity of goods is determined not only by their quantity, quality, description, or packaging, but also by compliance with both physical and non-physical standards. Unlike the traditional category of standards-public standard, private standard, mandatory standard and voluntary standard, this thesis suggests a different method. The starting point is the nature of the goods, then process standard and product standard play a vital role, as well as de facto mandatory standard. Also, this thesis shreds lights on the advantages and disadvantages of standards, the standards in CISG and the inherent jurisdiction of CISG.
