新冠疫情下海外留学生领事保护困境的法制应对
Legal Solution to the Dilemma of Consular Protection for Overseas Students under COVID-19
摘要: 新冠疫情发生以来，中国海外留学生合法权益遭遇重大挑战，我国政府采取了积极有效的领事保护措施，为海外留学生提供了有力支持。但疫情和领事保护实践也暴露了现有针对留学生领事保护法律制度的缺陷和不足。当前海外留学生领事保护法律制度实证分析结果表明，海外留学生领事保护法律制度存在法律位阶低、法规混乱、内容原则化、驻外领事馆通知不规范等问题。在国际法人本化潮流下，我国应当及时制定海外留学生领事保护专项法规，完善驻外使领馆通知，建立突发公共卫生事件下领事保护专项预案，以规范海外留学生领事保护工作。
Abstract: Since the occurrence of COVID-19, the legal rights and interests of China’s overseas students have been facing great challenges. Our government has taken effective and effective consular protection measures, which has provided strong support for overseas students. However, the epidemic situation and the practice of consular protection also exposed the defects and deficiencies of the existing legal system of consular protection for foreign students. The empirical analysis results of the current legal system of consular protection of overseas students show that there are some problems in the legal system of consular protection of overseas students, such as low legal level, chaotic regulations, principled content, non-standard notice of consulates abroad and so on. Under the trend of international legal person localization, China should timely formulate special laws and regulations on Consular Protection of overseas students, improve the notices of embassies and consulates abroad, and establish special plans for consular protection under public health emergencies, so as to standardize the consular protection of overseas students.
