“严重污染环境”之规范解释与认定标准

摘要: “严重污染环境”在污染环境罪中扮演着十分重要的角色，但是司法解释的偏差使得该罪出现行为与结果并存的二元入罪标准，引发了行为犯与结果犯、危险犯与实害犯等问题的讨论。关于污染环境罪的争议问题应当从该罪的法益着手，坚持生态学的人类中心法益观，对法益进行前置化保护。判断“严重污染环境”时应当统一认定方式，坚持行为标准，将结果作为结果加重犯处理，同时以抽象危险犯为本罪的基本形态，保留司法解释中的兜底性条款。
