摘要: 《民法典》首次通过立法确认了日常家事代理制度。然而，这一规定过于抽象和简洁，导致解释和适用上的模糊和困惑。因此有必要进一步厘清日常家事代理制度的法律属性与范围界定，并且对日常家事代理制度的适用限制问题进行讨论，以达到维护交易安全、保护婚姻家庭的立法目的。

Abstract: The Civil Code for the first time confirmed the daily family affairs agency system through legislation. However, this provision is too abstract and concise, leading to ambiguity and confusion in interpretation and application. Therefore, it is necessary to further clarify the legal attribute and scope definition of the daily family matter agency system, and discuss the application restrictions of the daily family matter agency system, so as to achieve the legislative purpose of maintaining transaction security and protecting marriage and family.
