Study on the Liability of Right Holders for Damages for Wrongful Notification

摘要: 权利人利用“通知–删除”规则发出错误通知，导致平台对被通知人的商品链接采取“删除”“下架”及“限权”等措施，给被通知人造成损失。该损失不仅包括被通知人因链接下架遭受的直接财产损失，还包括链接被下架后店铺预期收入、信誉、评价等下降的间接损失。因此，在明确错误通知的认定标准与危害后，可以从直接损失与间接损失等多角度探索错误通知损害赔偿应包含的内容、排除因素、计算顺序及计算方法。

Abstract: The right holder used the “notify-delete” rule to send a wrong notification, causing the platform to take measures such as “deleting”, “taking down” and “restrict-ing” the right of the notified person's product link and “restriction of rights”, causing losses to the notified person. The loss includes not only the direct property suffered by the notified person due to the downgrading of the link, but also the indirect loss of the store’s expected income, reputation, evaluation, etc. after the link was downgraded. Therefore, after clarifying the identification criteria and harms of wrongful notification, the contents, exclusion factors, calculation order and calculation methods that should be included in wrongful notification damages can be explored from multiple perspectives, such as direct loss and indirect loss.
