船舶碰撞中过错比例的认定——以陈某等与阿利兹航运公司船舶碰撞纠纷案为例
The Determination of Fault Proportions in Ship Collisions—A Case Study of the Ship Collision Dispute between Mr. Chen and Others vs. Aliz Shipping Company
摘要: 随着国际贸易的蓬勃发展,船舶运输作为重要的物流方式受到广泛关注。然而,船员技能、双方沟通、海上环境等多种因素的影响,船舶碰撞事故频发,碰撞责任争议纠纷成为一项重要议题,船舶碰撞中过错比例认定的重要性开始凸显。本文以船舶碰撞案例研究为中心,旨在明确船舶碰撞中的责任划分及损害赔偿规则。以“陈某某、詹某某等诉阿利兹航运公司案”为研究视角,对案件基本情况以及争议焦点进行概述,深入探讨船舶碰撞损害的归责原则,对在双方各有过失的情况下对责任比例的确定进行探讨,并结合现阶段我国相关法律存在的不足,提出完善对策与方案。
Abstract: With the vigorous development of international trade, ship transportation, as a crucial mode of logistics, has garnered widespread attention. However, due to various factors such as crew skills, communication between parties, and marine environments, ship collision accidents occur frequently, making disputes over collision liability an important issue. Consequently, the significance of determining the fault proportion in ship collisions has become increasingly prominent. Centered on case studies of ship collisions, this paper aims to clarify the rules of liability division and compensation for damages in such incidents. Taking the case of “Chen XX, Zhan XX, et al. v. Alize Shipping Company” as a research perspective, this paper outlines the basic facts and controversial issues of the case, delves into the principles of attribution for ship collision damages, discusses the determination of liability proportions when both parties are at fault, and proposes improvement measures and solutions in light of the deficiencies in China’s relevant laws at this stage.
