浅谈国际法上的不承认原则

A Brief Discussion about the Principle of Non-Recognition in the International Law

摘要: 在国际法基本理论与实践的研究中，“承认”一直作为众多国际法学者所讨论的颇有争议的论题，而对于“承认”的对立面“不承认”原则的讨论，在众多的承认相关问题的专著或论作中却鲜有列举。作者在阅读了有限的相关论著之后，以期以提出问题或者争议的方式对于不承认原则浅谈之，或者本文不能给出一个期待的答案，但是作者希望能够抛出这些问题，以引起更多学者们的关注。 In the research of basic theory and practice of International Public Law, “recognition”, as a very controversial topic, has always been discussed by international jurists. However, there is little discussion about “non-recognition” which is the opposite side of “recognition” in monographs on related problems. After reading some relevant but limited works, the authors want to discuss the non-recognition in the way of asking questions or referring disputes. Maybe we are not able to give out satisfied answers, but we do really hope to introduce these problems in order to attract more scholars.
