心理学视角下的证人证言
Psychological Perspective on Eyewitness Testimony
摘要:
证人证言与人的记忆有密切的关系。记忆具有场合依存性、自我参照性和情绪性，记忆的这些特性决定了它的易受污染性。本文探讨了记忆的特性，分析了法庭中的证人证言存在失实的可能性，进一步指出证人本身不具有辨别证言可信性的能力。鉴于证人证言在诉讼中的重要价值及心理学工作者对记忆的丰硕研究，有必要从心理学视角来研究证人证言。
Abstract: Eyewitness testimony is closely related to human memory. Memory has situational dependence, self-referential nature and emotionality, so it is easy to distort. This article discussed the charac-teristics of memory, analyzed the eyewitness testimony in court, and also reminded us that the eyewitnesses don’t have the ability to distinguish the credibility of testimony. In view of the im-portant value of eyewitness testimony in the proceedings and the abundant researches by psy-chologists on memory, psychological studies on eyewitness testimony are necessary.
