“放管服”三者关系的经济法思考——以“适度干预”理论为视角
Thoughts on the Economic Law of the Relationship between “Decentralizing, Management and Service”—From the Perspective of “Moderate Intervention” Theory
摘要: “放管服”是政府运用“适度干预”理论推行的一项改革实践。改革的关键在于对政府干预市场的“度”的限定,实践中通过放权市场、实现事后事中监管把握干预进程等举措积累了一定的界定经验,但是仍面临思维转变困难、“度”的标准模糊、干预能力待提升等现实困境。为进一步深化改革,需要对“政府干预”予以制度规范,将“放管服”改革纳入法制化路径中,推进建立干预问责和保障机制,同时建立社会中间组织协同评估制度,最终助力“放管服”改革的长足发展。
Abstract:
“Decentralizing, Management and Service” is a reform practice implemented by the government using the “moderate intervention” theory. The key to the reform lies in the definition of “degree” of government intervention in the market. In practice, it has accumulated certain defined experience through power decentralizing to the market and the implementation of post-event supervision and intervention process, but still faces difficulties in thinking transformation and “degree”, which is the real dilemma where standard ambiguity and intervention ability need to be improved. In order to further deepen the reform, it is necessary to standardize the “government intervention”, incorporate the “Decentralizing, Management and Service” reform into the legalization path, pro-mote the establishment of intervention accountability and guarantee mechanism, and promote the social intermediary organization to supervise government intervention, ultimately contributing to the long-term development of management “Decentralizing, Management and Service” reform.
