依法治教视阈下大学内部治理结构路径选择研究

Research on the Path Selection of Internal Governance Structure in the University under the Perspective of Law Governance

摘要: 法治既是实现教育现代化的可靠保障，也是现代教育治理的基本特征。而大力推进教育领域改革，健全完善大学内部治理结构，则是推进高等教育治理体系和治理能力现代化的必然要求。因此，全面深化改革、全面依法治教如鸟之两翼、车之两轮，共同推动教育现代化不断向前发展。在依法治教视阈下，主张建立健全依法行政的内部管理体制，规定大学利益相关者的地位和权力，理顺内部治理关系，促成各方良性互动，实现各项权利科学运转的顶层设计架构；主张在民主和科学的基础上完善高校内部决策体系，通过改革决策组织体制，推进决策的民主化、科学化进程。探索完善大学内部治理结构的路径，建立具有中国特色的现代大学治理制度。

Abstract: The rule of law is not only the reliable guarantee to realize the education modernization, but also the basic characteristic of modern education governance. It is necessary to promote the modernization of higher education governance system and governance capacity to vigorously promote the reform in the field of education and improve the internal governance structure of universities. Therefore, we should comprehensively deepen reform and administer education in accordance with the law, which is like the two wings of a bird and the two wheels of a vehicle, so as to jointly promote the continuous development of education modernization. From the perspective of administering education according to law, it advocates to establish and improve the internal management system of administration according to law, stipulate the status and power of university stakeholders, straighten out the internal governance relations, promote the positive interaction among all parties, and realize the top-level design framework of scientific operation of all rights. It is advocated to improve the internal decision-making system of colleges and universities on the basis of democracy and science, and promote the process of democratization and scientization of decision-making through the reform of decision-making organization system. We will explore ways to improve the internal governance structure of universities and establish a modern university governance system with Chinese characteristics.
