网络传播法视角下社交媒体中UGC版权问题探析

摘要: 本文基于对社交媒体平台上用户原创内容生态的观察,聚焦版权问题,分析了社交平台UGC版权保护方面问题屡现的原因,并基于对国内外学术研究与相关案例的充分考证,有针对性地提出切实对策与建议。研究发现,当前在“合理使用”概念界定、社交媒体平台责任与收益、用户维权成本、用户版权意识等方面存在的问题,是影响内容生态良性发展的主要原因;相应地,细化UGC版权保护法律法规、合理规划“避风港”、优化版权交易环境,以及推进普法教育与平台引导相结合,提高用户版权意识等成为管理者值得考量的选择。
Abstract: Based on the observation of user-generated content on social media platforms, focusing on copyright issues, this paper analyzes the reasons for the frequent problems in UGC copyright protection on social media platforms, and puts forward practical countermeasures and suggestions based on the full textual research on domestic and foreign academic paper works and relevant cases. This research found that the existing problems in the definition of the concept of “fair use”, the responsibility and benefits of social media platform, the cost of user rights protection, the awareness of user copyright and other aspects are the main reasons that affect the healthy development of content ecology. Accordingly, it has become a worthy choice for regulators to refine UGC copyright protection laws, reasonably plan “safe harbor”, optimize the copyright trading environment, promote the combination of legal education and platform guidance, and improve users’ copyright awareness.
