互联网+模式下劳动争议仲裁法律问题研究——以浙江劳动人事争议调解仲裁网络平台为例
Research on Legal Issues of Labor Dispute Arbitration under the Mode of Internet+ —Taking Zhejiang Labor and Personnel Dispute Mediation and Arbitration Network Platform as an Example
摘要: 随着“互联网+”技术的发展,构建网络法治的时代已经到来。劳动仲裁作为我国劳动争议案件处理的主要手段,不可避免地要开始探索网络仲裁的建设。近日,浙江省上线了浙江劳动人事争议调解仲裁网络平台,此平台是全国首例将劳动仲裁庭与互联网结合起来的仲裁平台,对劳动争议案件调处具有极其重要的意义。但是,刚搭建的网络平台在运行的过程中难以避免地会遇到一些问题,如庭审前管辖权归属问题,电子证据在举证质证过程中对证据“三性”认定问题,以及仲裁文书电子送达、衔接执行等问题。本文将以互联网法院为参考依据,探究该平台运行过程中可能出现的问题,并提出针对性的意见和措施,以便加以改进。
Abstract: With the development of “Internet+” technology, the era of constructing network rule of law has come. As the main means of handling labor dispute cases in our country, it is inevitable to start to explore the construction of network arbitration. Zhejiang province recently launched an online me-diation and arbitration platform for labor and personnel disputes, the first of its kind in China to combine labor arbitration tribunals with the Internet, which is of great significance for mediation of labor dispute cases. However, the newly-built network platform will inevitably encounter some problems in the process of operation, such as the jurisdiction before trial, the identification of “three characteristics” of evidence in the process of cross-examination of evidence by electronic evidence, and the electronic service and execution of arbitration documents. This paper will take the Internet court as the reference basis, explore the possible problems in the operation of the platform, and put forward targeted opinions and measures for improvement.
