网络性侵儿童犯罪的治理

Control of the Crime of Sexual Assault on Children on the Internet

摘要: 随着网络时代的快速发展，不少传统犯罪都发展出了多种线上犯罪形式和手段，这也使对犯罪的治理增加了难度。近几年，不少在网上性侵儿童的事件时有发生，我国保护儿童免受性侵害迫在眉睫。我国法律对此类现象的认定仍然界限模糊，对于在网络上对儿童进行性侵的特征、原因以及犯罪形式、手段等都没有深入的研究，这使得实践中面临此类现象出现判决上的参差，在预防和治理上也亟需专门探讨。为此，本文将结合犯罪学的角度对网络性侵儿童的犯罪案件进行进一步的研究。

Abstract: With the rapid development of the Internet age, many traditional crimes have developed a variety of online crime forms and means, which also makes the governance of crime more difficult. In recent years, many incidents of sexual abuse of children on the Internet have occurred from time to time, and it is imminent for our country to protect children from sexual abuse. The definition of such phenomena in our country’s laws is still vague, and there is no in-depth research on the characteristics, reasons, crime forms, and methods of sexual assault on children on the Internet, which makes the judgments of such phenomena in practice uneven. It also urgently needs to be specifically discussed in terms of prevention and treatment. For this reason, this article will conduct further research on the criminal cases of online sexual abuse of children from the perspective of criminology.
