防疫应急作用下的行政补偿——以酒店征用为例

Administrative Compensation under the Action of Epidemic Prevention and Emergency—Taking Hotel Requisition as an Example

摘要: 健全的应急征用补偿机制有利于行政相对人合法权益得到有效的保障，也有利于提高政府的公信力。对于我国目前的应急征用补偿机制在补偿范围、补偿标准、补偿方式合理性方面进行探讨分析，结合部分国外的行政补偿法律，基于疫情背景下隔离酒店征用的行政补偿为研究对象，提出相对的解决措施；应当以市场标准为主要参考依据的补偿标准进行直接补偿并规定最低补偿标准。

Abstract: A sound emergency requisition compensation mechanism can effectively protect the legitimate rights and interests of the administrative counterparty, and is also conducive to improving the credibility of the government. The current emergency requisition compensation mechanism in my country is discussed and analyzed in terms of the scope of compensation, compensation standards, and the ra-tionality of compensation methods. Combined with some foreign administrative compensation laws, based on the research object of administrative compensation for the requisition of isolated hotels under the background of the epidemic, relative solutions are proposed. Direct compensation should be made with the market standard as the main reference and the minimum compensation standard should be specified.
