民法典视野下数字遗产继承问题研究

Research on Digital Inheritance from the Perspective of Civil Code

摘要: 随着网络技术的发展，网络虚拟财产的使用范围也越来越广泛。其继承问题尤其突出，由于网络的特殊性，数字遗产的概念、法律属性、保护模式等在理论界存在着不同的定义，且在实践中数字遗产的继承问题由于缺乏法律依据而无法得到妥善处理。我国对于数字遗产的立法还处于起步阶段甚至空白阶段的情况下出现了很多法律规定难以适用的情况及法律解释。本文将从数字遗产的内涵，可继承性等角度进行分析，在借鉴域外经验的基础上，立足实践探讨数字遗产的立法保护、主客体认定等制度构建问题。

Abstract: With the development of network technology, the use of network virtual property is more and more extensive. Due to the particularity of the network, the concept, legal attribute and protection mode of digital heritage have different definitions in the theoretical circle, and in practice, the inheritance of digital heritage cannot be properly dealt with due to the lack of legal basis. When the legislation of digital heritage is still in its infancy and even in blank stage, many difficult legal provisions and legal interpretations appear. This paper will analyze the connotation and inheritability of digital heritage, and on the basis of learning from the experience outside the region, it will explore the legal protection of digital heritage, subject and object identification and other system construction issues based on practice.
