紧急仲裁员制度的特征研究——以ICC《关于紧急仲裁员程序的报告》为对象

A Study on the Characteristics of the Emergency Arbitrator System—Taking ICC’s “Report on the Emergency Arbitrator Proceedings” as an Object

摘要: 国际紧急仲裁员制度的建立旨在满足国际争端解决领域的紧迫需求，其在解决国际争端中发挥着不可或缺的作用。然而，这一制度也面临着一系列挑战，包括紧急仲裁员缺乏相关实质性的指引、适用范围存在限制、裁决跨国执行困难等。本文以2012~2018年的六年间80起申请了ICC紧急仲裁员程序的案例数据为样本，研究紧急仲裁员制度在这六年中的实践情况和自身制度的特征以及存在的问题，并提出相应的改善建议。

Abstract: The establishment of the international emergency arbitrator system aims to meet the urgent needs in the field of international dispute settlement, which plays an indispensable role in international dispute settlement. However, the system also faces a series of challenges, including the lack of relevant substantive guidance for emergency arbitrators, limitations in the scope of application and difficulties in cross-border enforcement of awards. Based on the data of 80 cases using the ICC emergency arbitrator proceedings during the six years from 2012 to 2018, this paper studies the practice of the emergency arbitrator system in these six years, the characteristics of its own system and the existing problems, and puts forward the corresponding improvement suggestion.
