我国药品专利链接制度分析

Analysis of China’s Drug Patent Link System

摘要: 随着新专利法以及《药品专利纠纷早期解决机制实施办法(试行)》的实施，我国药品专利纠纷早期解决机制逐步建立，为分析其实施情况。通过对中国上市药品专利信息平台的公示数据进行分析，并且采用理论逻辑分析来展示目前该制度的现状。药品专利纠纷早期解决机制对创新药以及仿制药的发展都具有重要的现实意义。深度探究了我国特色药品专利链接制度，细致分析了其运行机制及价值趋向；通过域外制度比较研究，结合我国医药发展及立法现状，为实践中可能出现的问题提出应对之策。

Abstract: With the implementation of the new Patent Law and the Implementation Measures for the Early Resolution Mechanism of Drug Patent Disputes (Trial), China has gradually established an early resolution mechanism for drug patent disputes to analyze its implementation. By analyzing the public disclosure data of China’s listed drug patent information platform and using theoretical logic analysis to demonstrate the current status of the system. The early resolution mechanism of pharmaceutical patent disputes has important practical significance for the development of innovative drugs and generic drugs. Deeply explored the patent linkage system for characteristic drugs in China, and analyzed its operating mechanism and value trends in detail; through comparative research on foreign systems, combined with the development and legislative status of medicine in China, propose countermeasures for possible problems that may arise in practice.
