平台经济反垄断下消费者权益保护法律规制
Legal Regulation of Consumer Rights Protection under Anti Monopoly in Platform Economy
摘要: 数字化时代新经济业态、交易模式、社会关系等不断出现,成为构建新发展格局、推动中国式现代化的重要引擎。平台经济应运而生、迅速发展,对国民经济发展的影响日益增强。目前,平台经济逐步形成以消费者为中心的竞争格局,其对消费者决策以及对消费者权益的影响极其明显。在平台经济下,消费者基本直接与平台经营者沟通,也更容易受到垄断的危害。保护消费者合法权益是反垄断法的重点,从保护消费者权益的角度看,反垄断法为完成该目标,在涉及反垄断立法时,应当重视对消费者权益的直接保护,完善相关法律规制;平台反垄断依法规范、强化监管,遏制平台垄断行为;构建完善的诉讼制度,当消费者权益受到侵害提起诉讼时,合理分配举证责任。
Abstract: In the digital era, new economic formats, transaction models, social relations, etc. are emerging, becoming an important engine for building a new development pattern and promoting Chinese path to modernization. The platform economy has emerged and developed rapidly, with an increasingly significant impact on the development of the national economy. At present, the platform economy is gradually forming a consumer centered competitive pattern, which has a significant impact on consumer decision-making and consumer rights. In the platform economy, consumers generally communicate directly with platform operators and are more susceptible to the harm of monopolies. Protecting the legitimate rights and interests of consumers is the focus of the Anti Monopoly Law. From the perspective of protecting consumer rights and interests, in order to achieve this goal, the Anti Monopoly Law should attach importance to the direct protection of consumer rights and interests and improve relevant legal regulations when it comes to anti-monopoly legislation; standardize and strengthen supervision of platform anti-monopoly in accordance with the law, and curb platform monopoly behavior; establish a sound litigation system to reasonably allocate the burden of proof when consumer rights are violated and a lawsuit is filed.
