第三方网络支付背景下存在的法律风险与解决路径
Legal Risks and Solutions in the Context of Third-Party Online Payment
摘要: 随着市场经济和社会的快速发展，互联网金融呈现出了爆发式的增长，我国的电子信息也进入了迅猛发展的时期。在电子信息和互联网的背景下，网络支付应运而生，但同时，网络支付行业迅速发展的步伐也带来了个人信息泄露，利用网络交易洗钱诸多问题。本文将通过对网络支付的界定出发，分析有关网络支付存在的风险，提出完善法律制度的建议。
Abstract: With the rapid development of market economy and society, Internet finance has shown explosive growth, and China’s electronic information has also entered a period of rapid development. Under the background of electronic information and the Internet, online payment came into being, but at the same time, the rapid development of the online payment industry has also brought about many problems such as personal information leakage and money laundering through online transactions. This paper will start from the definition of network payment, analyze the relevant legal provisions of network payment, and put forward suggestions to improve the legal system.
