数字时代电商平台反垄断规制——以自主学习类算法共谋的意思联络认定为视角
Anti-Monopoly Regulation of E-Commerce Platforms in the Digital Era—The Perspective of the Self-Learning Algorithm Collusion Is Identified as the Meaning Connection
摘要: 算法技术的发展使自主学习类算法共谋成为现实可能,算法决策的独立性和行为的隐蔽性,导致以垄断协议规制共谋时无法证明合意的存在。在数字时代的背景下,必须依靠合意的要约和承诺的表现,考察电商平台经营者的敏感信息共享和同步价格调整,确认上述行为包含心照不宣的彼此协商,以综合认定是否存在意思联络。
Abstract: The development of algorithm technology makes collusion of self-learning algorithms a reality, and the independence of algorithm decision-making and the concealment of behavior make it impossible to prove the existence of consensus when regulating collusion with monopoly agreements. In the context of the digital age, it is necessary to rely on the performance of consensual offers and acceptances, examine the sharing of sensitive information and synchronous price adjustments by operators, and confirm that the above-mentioned acts include tacit mutual negotiation to comprehensively determine whether there is a communication of intent.
