电子商务虚假信用评价的法律规制研究

Research on the Legal Regulation of False Credit Evaluation in E-Commerce

摘要: 随着电子商务经济快速发展，电子商务虚假信用评价现象日益严重。一些不法经营者通过刷单炒信、好评返现和恶意差评方式来损害消费者权益，扰乱电商市场的良好秩序。当前，我国有关法律法规对电子商务虚假评论行为的规制仍存在一定问题，行为主体的规制范围不全面，平台信用评价治理体系不健全，信用惩戒措施存在局限性。对此，应扩大行为主体的规制范围，强化平台信用评价治理责任、完善信用惩戒措施。

Abstract: With the rapid development of the e-commerce economy, the phenomenon of false credit evaluations in e-commerce is becoming increasingly serious. Some unscrupulous operators harm consumer’s rights and interests and disrupt the good order of the e-commerce market by means of fake orders, cashback for positive reviews, and malicious negative reviews. Currently, there are still certain problems in the regulation of false comments in e-commerce in China, including an incomplete scope of regulation for the subjects of behavior, an imperfect platform credit evaluation governance system, and limited credit penalty measures. In response, it is necessary to expand the scope of regulation for the subjects of behavior, strengthen the governance responsibility of platform credit evaluation, and improve credit penalty measures.
