唐代女性婚姻缔结选择初探

A Preliminary Exploration of the Marriage Choices of Women in the Tang Dynasty

摘要: 在中国古代传统社会发展中，家庭起着尤为重要的作用，这促使人们对婚姻投以高度关注。在法律规定之中，能够看出对于家庭伦理、等级秩序、私人财产等等的维护。值得注意的是，男性依旧处于主导性地位；相对来说，女性可选择的空间较为狭窄。但在唐朝开放的风气下，唐代女性的婚姻缔结选择保留着部分的自主权，并非完全是家族意志的体现，也能观察到唐代女性对于婚姻的态度，展示出了唐朝女性的相对独立地位。此种人情回归到法律规定中，时代的不平等却又难以消除，女性的权益保障仍旧处于不完全的状态。

Abstract: In the development of traditional Chinese society, the family played an especially important role, which led people to pay great attention to marriage. In the legal provisions, the maintenance of family ethics, hierarchical order, private property, etc. can be seen. Notably, men still held a dominant position. Relatively speaking, women had a narrower range of choices. However, under the open atmosphere of the Tang Dynasty, women in the Tang Dynasty still retained some autonomy in their marriage choices and were not entirely subject to the will of the family. This also reflects the attitude of Tang women towards marriage and demonstrates their relatively independent status. However, when this human sentiment returns to the legal provisions, the inequality of the times is still difficult to eliminate, and the protection of women’s rights remains incomplete.
