电商平台“七天无理由退货”规则的适用边界
The Applicable Boundary of the “Seven-Day No Reason to Return” Rule on E-Commerce Platforms
摘要: “七天无理由退货”规则是《消费者权益保护法》的重要制度,意在平衡消费者与经营者之间的利益关系,应对网络购物等新兴消费模式下信息不对称等问题。然而,该规则在实践中的准确适用面临诸多挑战。根据该规则适用的法定条件,建立商品类别排除、商品状态限制、退货程序要求及诚实信用原则约束四重边界,有助于构建公平有序的市场交易环境。
Abstract: The rule of “seven-day no reason to return” is an important system of the “Law on the Protection of Consumer Rights and Interests”, which is intended to balance the interests of consumers and business operators, and deal with the problems of information asymmetry in emerging consumption modes such as online shopping. However, there are many challenges to the accurate application of this rule in practice. According to the legal conditions applicable to the Rules, the establishment of a four-fold boundary of commodity category exclusion, commodity status restrictions, return procedure requirements and the principle of good faith is conducive to building a fair and orderly market trading environment.
