数字经济时代下电商平台的知识产权保护困境与出路
Challenges and Solutions for Intellectual Property Protection in E-Commerce Platforms in the Era of Digital Economy
摘要: 数字经济的飞速发展对知识产权保护提出了更高要求,电商平台作为知识产权保护的重要阵地,其治理模式和法律规制亟需完善。由于法律规定的模糊性使得司法机关对于电商平台涉知识产权纠纷案件裁判不一,何为“知道或者应当知道”“必要措施”,“恶意通知”如何认定和适用,尚需进一步明确。电商平台掌握着资源、技术和数据信息,拥有一定的自治权,是平台治理的重要主体。如何在电商平台、平台内经营者和权利人之间寻求平衡,是当前重点关注的问题。与电商平台相比,平台内经营者处于相对弱势的地位,维权能力较弱,要强化平台内经营者的权利意识和责任意识,推动其积极参与知识产权保护,打造更加公平、公正的电商生态。
Abstract: The rapid development of the digital economy has imposed heightened demands on intellectual property protection. As a crucial frontier in safeguarding intellectual property rights, e-commerce platforms urgently require enhancements in their governance models and legal regulations. The ambiguity of legal provisions has led to inconsistent adjudications by judicial authorities in intellectual property disputes involving e-commerce platforms. Key concepts such as “knowledge or should have known”, “necessary measures” and the identification and application of “malicious notifications” necessitate further clarification. E-commerce platforms, which control resources, technology, and data, possess a degree of autonomy and are pivotal entities in platform governance. A critical issue of current focus is achieving a balance among e-commerce platforms, platform operators, and rights holders. Compared to e-commerce platforms, platform operators are in a relatively disadvantaged position with weaker rights protection capabilities. It is imperative to strengthen the rights awareness and responsibility consciousness of platform operators, encouraging their active participation in intellectual property protection to foster a more equitable and just e-commerce ecosystem.
