跨境电商平台对进口商品质量的法律责任研究
Research on the Legal Liability of Cross-Border E-Commerce Platforms for the Quality of Imported Goods
摘要: 随着跨境电商进口业务快速发展,进口商品质量问题频发,跨境电商平台的法律责任界定成为行业治理与消费者权益保护的核心难题。本文基于我国相关法律规定,系统探讨平台在进口商品质量管控中的法律地位、归责原则及责任边界。研究发现,我国现行法律存在责任界定模糊、法律适用冲突、监管协同不足等实践困境。通过对比国际先进经验,提出从立法完善、监管强化、消费者权益保护机制优化三方面完善责任体系,旨在明确平台质量责任边界,保障消费者合法权益,推动跨境电商行业规范有序发展。
Abstract: With the rapid development of cross-border e-commerce import business, quality problems of imported goods occur frequently. The definition of legal responsibilities of cross-border e-commerce platforms has become a core challenge in industry governance and consumer rights protection. Based on relevant laws and regulations in China, this article systematically explores the legal status, liability principles and responsibility boundaries of platforms in the quality control of imported goods. The research finds that the current laws in our country have practical predicaments such as ambiguous definition of responsibilities, conflicts in the application of laws, and insufficient regulatory coordination. By comparing international advanced experience, it is proposed to improve the responsibility system from three aspects: legislative improvement, strengthened supervision, and optimization of consumer rights protection mechanisms. The aim is to clarify the quality responsibility boundaries of platforms, safeguard the legitimate rights and interests of consumers, and promote the standardized and orderly development of the cross-border e-commerce industry.
