直播带货中的法律问题分析及应对策略

摘要: 直播带货的兴起给人们带来了全新的购物体验,便捷了交易的同时也促进社会经济的发展。但是新事物的兴起往往也伴随着一系列法律问题的出现,由于直播带货相关的法律规定不完善再加上监管不到位导致的消费者维权困难、虚假宣传等问题频发。因此,本文将对直播带货的概念、性质以及类型进行简单介绍,再重点分析其中三个常见的法律问题,分别是法律制度不完善、消费者维权成本高以及监管机制的欠缺。提出要进一步完善直播带货的法律体系、降低诉讼成本以及发挥监管部门对行业的监督作用,从而使直播带货行业朝着更加稳定的方向发展,更好地促进社会经济稳步增长。
Abstract: The rise of live-streaming e-commerce has brought a brand-new shopping experience to people, facilitating transactions and promoting the development of social economy. However, the emergence of new things is often accompanied by a series of legal issues. Due to the imperfect legal regulations related to live-streaming e-commerce and inadequate supervision, problems such as difficulties for consumers in safeguarding their rights and illegal publicity have occurred. Therefore, this article will briefly introduce the concept, nature, and types of live-streaming e-commerce, and then focus on analyzing three common legal issues: the imperfect legal system, high costs of consumer rights protection, and the lack of regulatory mechanisms. It is proposed to further improve the legal system of live-streaming e-commerce, reduce litigation costs, and play the supervisory role of regulatory authorities over the industry, so that the live shopping industry can develop towards a more stable direction and better promote the steady growth of the social economy.
