Research on Legal Obligations and Responsibilities of Network Trading Platform

摘要: 当今世界互联网技术发展迅猛，购物早已打破传统的线下实体交易与运输模式。由于网络购物便捷高效，人们足不出户就可以浏览大量丰富的产品，选择心仪商品，再通过快递等运输服务将商品运到便利买家的地点，越来越多的人开始选择网络购物，继而网络购物越来越普遍。随之，也出现了许多新的问题和法律纠纷，买家与卖家、卖家与网络交易平台、买家与网络交易平台之间利益交错，因此理清各方法律地位、法律义务与法律责任至关重要。本文以网络交易平台的含义为开端，通过分析网络交易平台在交易中的角色定位以及其作为交易平台应当承担的义务与责任，根据现行有效的相关法规及交易现状，分析相关制度与法律法规的不足之处并提出相关法律建议。

Abstract: Nowadays, with the rapid development of internet technology, shopping has long broken down into traditional offline trading and transportation modes. Because online shopping is convenient and efficient, people can browse a large number of rich products, choose their favorite goods, and then transport goods to convenient buyers through express delivery services. More and more people are beginning to choose online shopping, and online shopping is becoming more and more common. With this, there are also many new problems and legal disputes. Therefore, it is very important to clarify the legal status, legal liability, and obligations between buyers and sellers, sellers and network platform providers, and buyers and online trading platforms. Starting from the meaning of the online trading platform, this paper studies the obligations and responsibilities of the online trading platform by analyzing the different status and roles of the online trading platform, and according to the current effective online shopping laws and regulations and the current situation of online transactions, analyzes the shortcomings of the relevant systems and laws and regulations, and puts forward relevant legal suggestions.
