海运货物留置权的适用困境及完善
Application Dilemmas and Improvements of Maritime Cargo Liens
摘要: 海运货物留置权作为承运人保障债权实现的重要担保物权,在《海商法》与《民法典》的规范冲突下面临适用困境。《海商法》第87条将留置货物严格限定为“债务人所有的货物”,而《民法典》第836条允许留置“相应的运输货物”且不设权属限制,导致司法实践中出现裁判分歧。当前困境主要体现在:商事留置权性质不明确,导致对“同一法律关系”要件的认定存在争议;权属限制与国际贸易中货物所有权频繁转移的现实脱节,增加承运人审查负担;处置程序单一僵化,仅允许法院拍卖的方式影响债权实现效率。为完善制度,建议明确海运货物留置权的商事属性,放宽权属限制,优化处置程序,以平衡各方权益,促进航运业健康发展。
Abstract: As an important security interest for carriers to protect the realization of creditor rights, maritime cargo liens face application dilemmas under the conflicting regulations of the Maritime Code and the Civil Code. Article 87 of the Maritime Code strictly limits the lien on goods to “goods owned by the debtor”, while Article 836 of the Civil Code permits liens on “correspondingly transported goods” without ownership restrictions, leading to discrepancies in judicial practice. The current dilemmas primarily manifest in: the ambiguous nature of commercial liens, resulting in disputes over the identification of the criteria for “the same legal relationship”; a disconnect between ownership restrictions and the frequent transfer of ownership in international trade, increasing the scrutiny burden on carriers; and a rigid disposal procedure that only allows court auctions, affecting the efficiency of debt realization. To improve the system, it is recommended to clarify the commercial nature of maritime cargo liens, relax ownership restrictions, and optimize disposal procedures to balance the interests of all parties and promote the healthy development of the shipping industry.
