回头背书制度研究

A Study on the Back Endorsement System

摘要: 背书制度是票据法的核心制度，而回头背书作为一种特殊的转让背书，是以票据上的原债务人为被背书人的转让背书，其特殊性体现在票据债务人与票据债权人身份的重合。但我国《票据法》对回头背书的规定仅限于第69条，无法解决实务中出现的回头背书再背书时追索权行使的问题以及回头背书中抗辩权行使的问题。因此，需要对我国《票据法》上的回头背书制度进行完善。

Abstract: The endorsement system is the core system of the Negotiable Instruments Law. As a special transfer endorsement, the endorsement is a transfer endorsement in which the original debtor on the note is the endorsed. Its particularity is reflected in the overlap of the identities of the debtor of the note and the creditor of the note. However, my country’s Negotiable Instruments Law stipulates that the back endorsement is limited to Article 69, which cannot solve the problem of the exercise of the right of recourse when back endorsement and re-endorsement and the exercise of the right of de-fense in the back endorsement in practice. Therefore, it is necessary to improve the back endorse-ment system in my country’s Negotiable Instruments Law.
