摘要: 随着我国老龄化的问题越来越严重，各类老龄产业就成为了亟待发展的朝阳产业。机构养老对我国目前养老服务发展产业是不可或缺的，但如何处理好对于老年人监护的问题，涉及到了许多老年人和扶养人的切身权益。老人入住养老机构之后，是否意味着养老机构就变成他们的监护人，老人在养老机构的一切行为都由养老机构负责。这样的问题探讨层出不穷，本文探究了入住养老院的无民事行为能力人、限制民事行为能力人侵权责任的承担，旨在更好维护社会公正，保障老龄产业健康发展。

Abstract: With the aging problem becoming more and more serious in China, all kinds of aging industries have become sunrise industries to be developed urgently. Institutional endowment is indispensable to the development of China’s pension service industry at present, but how to deal with the problem of custody of the elderly, involves the vital rights and interests of many elderly people and their dependants. After the elderly live in the pension institution, does it mean that the pension institution will become their guardian? All the behaviors of the elderly in the pension institution are responsible for by the pension institution. This paper explores the tort liability of people without civil capacity and people with limited civil capacity in nursing homes, in order to better maintain social justice and ensure the healthy development of the aging industry.
