“三权分置”下农村宅基地使用权的相关法律问题研究

Research on Relevant Legal Issues of Rural House Land Use Right under “Three Rights Separation”

摘要: 宅基地制度是我国特有的一项土地制度，随着社会经济的发展和人民生活水平的不断提高，宅基地的财产属性越来越突出。在2018年，乡村振兴战略提出了探索宅基地“三权分置”的改革，2020年国务院再次阐述了宅基地“三权分置”制度改革的重要性，增强农村宅基地的改革试点。宅基地“三权分置”改革是“三农”工作领域中的重点工作，但是宅基地使用权的相关政策与法律之间存在冲突，并且其管理制度无法落实，在流转过程中存在很多困境，应对其进行法律分析，进一步完善“三权分置”下农村宅基地的使用权。

Abstract: The homestead system is a special land system in our country. With the development of the social economy and the improvement of people’s living standards, the property attribute of the home-stead is more and more prominent. In 2018, the rural revitalization strategy proposed the reform of exploring the “three rights separation” of residential land. And in 2020, the State Council again expounded the importance of the reform of the “three rights separation” system of residential land. We will strengthen the pilot reform of rural housing sites. The reform of “three rights separation” of housing land is the key work in the field of “agriculture, countryside and farmers”, but there are conflicts between relevant policies and laws on the right to use housing land, thus its management system can’t be implemented, and there are many difficulties in the process of circulation. The “three rights separation” system should be legally analyzed to further improve the rural homestead use rights.
