The Nature of the “Gift” of Property to the Children in the Divorce Agreement

摘要: 夫妻签订离婚协议时，出于弥补婚姻关系解除对子女所造成的身心伤害、提前为子女未来婚嫁立业作出安排等方面的考虑，在财产分割部分作出将房产“赠与”给子女之约定，并不鲜见。此类约定并非与子女之间就房产“赠与”所作的合意，而是意欲赋与子女某种利益之第三人约款。从价值判断上看，利他合同说更加接近当事人的真意、符合诚信原则的要求和保护未成年子女的特殊法政策；从法律逻辑上看，也并未突破利他合同制度的边界，相反，此种案型可作为运用补充解释识别利他合同的典型，助力“推定利他合同”的类型化。

Abstract: It is not uncommon for a couple to sign a divorce agreement in which they agree to “gift” property to their children for the purpose of making up for the physical and psychological harm caused by the divorce to the children and making advance ar-rangements for the children’s future marriage and establishment. Such agreements are not con-sensual agreements with the children regarding the “gift” of property, but rather third-party agreements intended to confer certain benefits on the children. In terms of value judgment, the al-truistic contract is closer to the true intention of the parties, in line with the requirements of the principle of good faith and the special legal policy of protecting minor children; in terms of legal logic, it does not break the boundaries of the altruistic contract system, rather, this type of case can be used as a typical example of using supplementary interpretation to identify altruistic contracts and help the typology of presumed altruistic contracts.
