论风险社会背景下的行政处罚公开
On the Disclosure of Administrative Punishment under the Background of Risk Society
摘要: 在风险社会背景下,行政法面临巨大挑战,行政处罚也不例外。2021年7月,新修《行政处罚法》开始实施,第48条1的规定为行政处罚公开提供了合法性依据。本文将从“李某迪嫖娼案”公开后引起热议这一事件为问题的引发点,来展开探究。笔者发现在风险社会背景下的行政处罚公开可能会存在“具有一定社会影响”认定、行政处罚公开权益平衡、行政处罚公开威慑力、行政处罚公开即时性等问题。对此,笔者试图从“具有一定社会影响”标准量化、规范信息公开原则以促权益保护、贯彻落实比例原则以便处罚相当、建立相应配套立法促进制度完善等方面提出完善设想。
Abstract:
In the context of risk society, administrative law faces great challenges, and administrative punishment is no exception. In July 2021, the newly revised Law on Administrative Penalties came into effect, and the provisions of Article 48 provided a legal basis for the public disclosure of administrative penalties. This article will be from the “Li Mou Di prostitute case” after the public hot discussion to explore. The author found that the disclosure of administrative punishment in the context of risk society may have “a certain social impact” identification, the balance of rights and interests of administrative punishment disclosure, the deterrence of administrative punishment disclosure, and the immediacy of administrative punishment disclosure. In response, the author tries to quantify and standardize the principle of information disclosure from the standard of “having a certain social impact” to promote the protection of rights and interests and implement the proportionality principle for equal punishment and establishment, provide some suggestions in the aspects of corresponding supporting legislation to promote the perfection of the system.
