我国劳动者权益保障困境及《劳动法》落实的问题探析
Analysis on the Dilemma of the Protection of Laborers’ Rights and Interests and the Problem of Implementing Labor Law in China
摘要: 我国的《劳动法》在很早之前就对劳动者的工作时长进行了相关规定。然而在法律法规的明确规定之下,我国劳动者工作时间却越来越长,“996”“007”等工作制度的出现,不仅侵害了劳动者的权益,更违反了法律规定。加班现象严重的问题本质上反映了我国劳动者权益保障受到侵害的现状。本文立足于劳动者工作时长的现状研究,关注我国劳动者权益保障困境中的加班问题,从而找出我国《劳动法》落实的难点和优化的突破口。
Abstract: China’s Labor Law has long stipulated the working hours of laborers. However, under the clear provisions of laws and regulations, the working hours of Chinese workers are getting longer and longer, and the emergence of work systems such as “996” and “007” not only infringes the rights and interests of workers, but also violates the provisions of laws. In essence, the serious problem of overtime phenomenon reflects the infringement of the rights and interests of the laborers in our country. This paper is based on the research of the current situation of working hours of laborers, and pays attention to the overtime problem in the dilemma of protecting laborers’ rights and interests, so as to find out the difficulties in the implementation of China’s Labor Law and the breakthrough of optimization.
