摘要: 非同质化代币(NFT)数字作品是区块链技术在版权领域的创新应用。非同质化代币具有唯一性、不可分割性、不可篡改性、可溯源性等特点，基于这些特点，NFT数字作品交易与传统交易形式相比具有提升创作者议价地位、减少交易成本等优势。随着NFT数字作品交易的火爆，NFT交易中所存在的诸如仿冒欺诈、版权交易稳定性不足、侵权难以规制等问题也逐渐显现出来。本文将进一步分析NFT数字作品版权问题的表现及成因，并提出提升平台自治、加强监管以及出台相关法律解释的建议，以期NFT行业能更平稳健康的发展。

Abstract: Non-homogeneous token (NFT) digital works is an innovative application of blockchain technology in the field of copyright. Non-homogenous tokens are unique, indivisible, untamable and traceable. Based on these characteristics, compared with traditional transaction, NFT digital works transaction has the advantages of improving the bargaining position of creators and reducing transaction costs. With the rapid development of digital works trade in NFT, some problems such as counterfeit fraud, lack of stability in copyright trade and difficulty in regulation of copyright infringement are emerging. This article will further analyze the performance and causes of NFT digital works copyright issues, and put forward suggestions to enhance the platform autonomy, strengthen supervision and issue relevant legal interpretation, with a view to the NFT industry can be more stable and healthy development.
