摘要: “互联网+”的应用和发展，为势头正盛的网络交易提供了技术基础，网络购物逐渐成为人们生活的必要方式。电商平台的商家排名方式和用户评价机制催生了“刷单行为”的兴起，然而现行法律对于“刷单”行为的规制存在行为构成要件缺乏、法律责任不明等问题，从制度上明确“刷单炒信”的法律定性，是完善其行为构成要件从而明晰相关法律责任的基础，加强监管是处罚和规制的必要，只有从制度和行动上的有效联动才能实际打击破坏公平诚信交易秩序的“刷单炒信”行为。

Abstract: The application and development of “Internet+” has provided the technical foundation for the flourishing online transaction, and online shopping has gradually become a necessary way of people’s life. The merchant ranking method and user evaluation mechanism of e-commerce platforms have given rise to the rise of “single brushing behavior”. However, the existing laws regulate the “single brushing” behavior with problems, such as lack of behavioral components and unclear legal responsibility. Clarifying the legal quality of “single brushing and letter speculation” from the system is the basis for improving its behavioral components and clarifying relevant legal responsibilities. Strengthening supervision is necessary to punish and regulate. Only from the effective linkage of system and action can actually combat the “brushing single speculation” behavior that destroys the fair and honest trading order.
