电子商务发展背景下的非法集资犯罪研究

摘要: 近年来，随着电子商务的平台发展，利用电商平台开展的非法集资活动层出不穷。2022年河南村镇银行事件骇人听闻，由虚拟货币、私募股权交易、P2P网贷等伪装而成的非法集资活动展现出新形态。电子商务发展背景下的非法集资活动表现出科技化、跨境化等特点，为互联网金融领域监管带来很大难题。为此，应加强对电子商务领域非法集资活动的治理，完善法律体系、提升电商平台自我监管和政府监管、加强公众宣传教育，以维护电商金融安全，推动互联网经济蓬勃发展。

Abstract: In recent years, with the development of e-commerce platforms, illegal fundraising activities have been rampant on these platforms. The shocking incident of a village bank in Henan Province in 2022 showed that illegal fundraising activities disguised as virtual currencies, private equity transactions, and P2P lending have taken on new forms. Illegal fundraising activities in the context of e-commerce development have shown characteristics such as technological advancement and cross-border involvement, posing significant challenges for internet finance regulation. Therefore, it is necessary to strengthen the governance of illegal fundraising activities in the e-commerce field, improve the legal system, enhance self-regulation and government regulation of e-commerce platforms, and enhance public education to maintain the financial security of e-commerce and promote the vigorous development of internet economy.
