Guaranteeing the Realization of the Subrogation Rights of the Multilateral Investment Guarantee Agency under the “Belt and Road” Initiative

摘要: 在对外投资中需要充分发挥多边投资担保机构(Multilateral Investment Guarantee Agency，以下简称MIGA)的作用，我国企业海外投资不仅没有获得本国投资担保机构的有效保障，对于MIGA担保机制的利用率也极低，MIGA的代位求偿权的保障实现需要通过双边海外投资保险制度的建立、鼓励中小企业可以尝试利用MIGA中小投资计划快速获得担保等方式。

Abstract: In the process of foreign investment, the role of Multilateral Investment Guarantee Agency (MIGA) should be fully utilized. Chinese enterprises’ overseas investment not only did not get the effective guarantee of their own investment guarantee agency. The utilization rate of MIGA’s guarantee mechanism is also very low, and the guarantee of MIGA’s subrogation needs to be realized through the establishment of bilateral overseas investment insurance system, encouraging smes to try to use MIGA’s small and medium-sized investment program to obtain guarantees quickly.
