电子商务平台经营者的侵权责任法律适用探究

Research on the Legal Application of Tort Liability of E-Commerce Platform Operators

摘要: 我国的《消费者权益保护法》《电子商务法》对电商平台经营者的侵权责任进行了规定，但是在法律适用方面仍然存在着一些问题。本文将从最大限度地保护消费者利益的角度出发，厘清电子商务平台经营者的法律地位，明确其在共同侵权中所承担的责任类型，立足于国内立法及司法现状，讨论我国目前电子商务平台经营者侵权责任在法律适用中存在的问题并提出相应的完善对策。

Abstract: China’s “Consumer Rights Protection Law” and “E-Commerce Law” stipulate the tort liability of e-commerce platform operators, but there are still some problems in the application of law. From the perspective of protecting the interests of consumers to the maximum extent, this paper will clarify the legal status of e-commerce platform operators and clarify the types of liability they bear in joint infringement. Based on the domestic legislation and judicial status, this paper will discuss the existing problems in the application of the tort liability of e-commerce platform operators in China and propose corresponding countermeasures.
