电商平台商标间接侵权责任研究

Research on Indirect Trademark Infringement Liability of E-Commerce Platform

摘要: 自从2019年《电子商务法》实施以来，电商平台一直在加快构建知识产权保护体系。但电商平台中的商标侵权行为却一直存在，本文将以《电子商务法》第四十二至四十五条为视角分析电商平台所应承担的间接侵权责任，理清“红旗”规则与“避风港”规则的性质，分析电商平台的过失认定以及《电子商务法》中的不足之处，以保护各方当事人的合法权益，为营造良好的网络经营环境保驾护航。

Abstract: Since the implementation of the E-commerce Law in 2019, e-commerce platforms have been accelerating the construction of intellectual property protection systems. However, trademark infringement has always existed on e-commerce platforms. This paper will analyze the indirect liability of e-commerce platforms under Articles 42 to 45 of the E-commerce Law, clarify the nature of the “red flag” rule and the “safe harbor” rule, analyze the criteria for determining the negligence of e-commerce platforms, and identify the shortcomings of the E-commerce Law to protect the legitimate rights and interests of all parties involved and ensure a favorable online business environment.
